Tymoshenko Not to be Summoned to Court

Jailed Ukrainian ex-Prime Minister Yulia Tymoshenko will not be summoned on Monday to court hearing in which she is accused of financial fraud during her tenure as head of the United Energy Systems of Ukraine corporation in the 1990s, the Ukrainian penitentiary authority said on Sunday.

“The Ukrainian state penitentiary service declares that Yulia Tymoshenko will not be summoned to court due to her written refusal to participate in the court hearings citing the conclusion of German professor Karl Max,” a statement said.

On Saturday head of the German Charite clinic Karl Max Einhaeupl visited Tymoshenko in a hospital of Kharkov where he checked her health.

“German doctors advised not transport Tymoshenko so not to harm the successful treatment process. They also noted that Tymoshenko’s ability to carry loads will significantly improve in a few weeks,” the penitentiary authority said in its statement.

Timoshenko’s refusal and German doctors’ conclusion will be sent to the court.

A summons letter was received by management of the Kachanovskaya Penal Colony in the eastern Ukrainian city of Kharkov, where Tymoshenko has been jailed.

The Ukrainian Health Ministry recommended that comfortable conditions be created in the courtroom for Tymoshenko.

According to the penitentiary authority, Tymoshenko was informed on Friday, but she did not give answer whether she was going to court hearings saying she awaits recommendations of German doctors.

The opposition heroine of Ukraine's 2004 pro-democracy Orange Revolution was found guilty of abusing her power by pushing through a 2009 gas deal with Russia in a controversial trial in October 2011 and sentenced to seven years behind bars. Her trial was condemned by Russia and Western governments as politically motivated.
